SEC Threatens Former Brobeck Lawyer Over Client Accounting Probe

The SEC could bring its first-ever lawsuit against a lawyer who helped with a company’s internal accounting probe, Bloomberg News reported. The move is seen as part of the SEC’s broadening pursuit of professional advisers in corporate fraud cases.


The SEC told former Brobeck Phleger & Harrison partner Christopher McGrath more than a month ago that he could face civil sanctions for his role in an investigation at Irvine-based medical device maker Endocare Inc. It’s not known what McGrath did to rouse the SEC. An Endocare press release issued last year said that the probe McGrath conducted found no “intentional wrongdoing by management.” One month later, Endocare said it was under investigation by the Justice Department and the SEC.


Brobeck Phleger & Harrison, which had 900 lawyers in offices scattered nationwide at its peak, shut down in Feb. 2003 after suffering financial problems.
